Courts/Legal Issues States - Tamil Nadu ‘GO declaring Friday holiday for fair price shops in Nilgiris legal’ Our Legal Correspondent Chennai, March 11 Opening of fair price shops on Sundays in Nilgiris district of Tamil Nadu could not be objected to since card-holders there were plantation workers and for them Sunday was the only holiday available, the Madras High Court has ruled. Dismissing a writ petition by TN Anaithu Kooturavu Niyayavilaikadai Paniyargal Sangam (Co-op Fair Price Shop Workers Union) challenging the order dated 23-10-2007 of Food & Consumer Protection Department, Mr Justice K. Chandru held that insofar as co-op employees were concerned, dealing in essential commodities was an additional responsibility entrusted with them not by co-op department but by authorities under Essential Commodities Act. If fair price shops in the district were kept closed on Sundays, these workers would be put to great hardship. Only after taking all these factors into account, the impugned order declaring Sundays as working days was issued. The judge said that there could not be any objection to opening of shops on Sundays instead of Fridays taking into account need of local population. Petitioner union, if it was aggrieved, would very well be advised to raise an industrial dispute, and refer the matter to be adjudicated by an appropriate forum.
