Courts/Legal Issues States - West Bengal HC reserves orders on Birla Will case Our Legal Correspondent Kolkata, May 9 The probate case of the late Priyambada Birla took a new turn on Friday when the issue of Mr G.P. Birla being added as a party was taken up, in compliance with an order of the Supreme Court, before Mr Justice K.J. Sengupta of the Calcutta High Court. The Probate and Letter of Administration (PLA) applications have been filed. Mr R.S. Lodha has been appointed executor of the Will of Priyambada Birla. After her death, the probate proceeding was filed by Mr Lodha when the Birlas filed caveats. The court held that G.P. Birla had a caveatable interest. The Supreme Court has held that since, in the main petition, Mr G.P. Birla was not a “party”, the High Court should make G.P. Birla a party. The Counsel for Mr Lodha has challenged the assignment before Mr Justice Sengupta. It was contended that the PLA had not been assigned, only the applications had been. The Counsel requested that the matter be placed before the Chief Justice for clarification. Filing another application, Mr P.K. Khaitan and Mr Tapuria, claiming to be executors of the 1982 Will of Priyambada Birla, wanted to be parties but the court did not accept the petition for the time being.
