HC quashes plea against Vizhinjam project contract

The Kerala High Court on Thursday dismissed a writ petition filed by Zoom Developers against the State Government and Vizhinjam International Seaport Ltd for disqualifying the proposal submitted by the consortium for construction of the Vizhinjam Deepwater Seaport and International Transhipment Container Terminal.

According to the petitioner, five consortia had submitted tenders for the project. Of them, three were pre-qualified. They were Lanco Consortium, Videocon Consortium and Nagarjuna Consortium.

Zoom Consortium and Apollo Consortium were disqualified.

Zoom was disqualified on the main ground that they had changed the consortium partners after the final date of submission of the agreement and that they had not stated that they would be jointly and severely liable for execution of the project.

The work for the construction was finally awarded to the Lanco Kondapalli Power Pvt Ltd, Hyderabad.

Dismissing the petition, Mr Justice Thottathil B. Radhakrishnan said that the decision arrived at by the government and the Seaport company thorough the High Level Bid Evaluation Committee was not vitiated.
