Courts/Legal Issues HC refuses to grant interim order to Dunlop Our Legal Correspondent Kolkata, July 14 A Division Bench of the Calcutta High Court comprising Mr S.S. Nijjar, Chief Justice, and Mr Justice P.C. Ghose, on Monday refused to grant interim order to Dunlop India Ltd (DIL). Earlier, when Central Excise Authority in 1992 went to DIL factory at Sahagunj, West Bengal, for taking stock for adjustment, they found shortage of goods. Accordingly, on January 15, 1993, a show-cause notice was served. Finally on March 21, 2006, the Central Excise Service Tax Appellate Tribunal, after due consideration, dismissed the appeal made by Dunlop and held that the company is to pay Rs.14,52,000 as demand and penalty. This order was challenged before Ms Justice Indira Banerjee of Calcutta High Court and was dismissed. Against this dismissal, DIL had moved the Court of appeal. In another proceeding over PF dues, DIL got the interim order extended, which Mr Justice Aniruddha Bose granted, allowing the company to operate bank accounts.
