IPAB hears Novartis’ Glivec case

Mumbai, Nov. 17 The review of Novartis’ rejected patent application on its cancer drug Glivec came up for hearing before the Intellectual Property Appellate Board (IPAB) on Monday.

The IPAB had said, earlier this month, that it would hear the case on a “day-to-day” basis.

Novartis would make its submission, followed by Cancer Patients Aid Association, Natco, Ranbaxy, Hetero and Cipla, said a lawyer handing the case. The hearing is expected to go on for two weeks, the legal source added.

Novartis’ patent application on Glivec had been rejected by the Indian Patent Office in January 2006. The pharma industry and several non-profit organisations are closely watching the developments, as it would be a benchmark case.

Glivec was the first pharmaceutical product in the country to be given an Exclusive Marketing Right in 2003, in a run-up to the introduction of the product patent regime in the country in January 2005. The product has been mired in litigation, ever since.
