SC hearing today on cable TV pricing

New Delhi, Feb. 10 The Supreme Court has listed the issue of cable TV pricing for hearing on Wednesday.

An order amending the tariffs for cable services (in non-CAS areas) issued in October 2007 by the Telecom Regulatory Authority of India had been set aside by the Telecom Disputes Settlement Appellate Tribunal (TDSAT) last month. TRAI had filed an appeal in the Supreme Court against the TDSAT ruling.

The TRAI order issued on October 4, 2007 specified the ceilings on how much a cable operator could charge consumers every month.

They were defined by cities and number of channels.

The maximum prices ranged between Rs 77 (for 30 free to air channels) and Rs 260 (for a minimum 30 free to air and more than 45 pay channels).

Those cable operators charging less than these rates were also to be allowed an increase of 4 per cent on existing charges once the order came into effect.

Broadcasters had also been told to provide their channels on a la carte basis (rather than clubbing them in bouquets) and declare a la carte rates to the multi system operators and cable operators.

The composition of TV channel bouquets as on December 1, 2007 had also been frozen.

Setting aside this order on January 15, 2009, TDSAT had said the “obligation of transparency had not been fulfilled”.

Further on the issue of whether the classification of cities and towns as well as the slab system stipulated by the order, TDSAT had held that the price ceiling fixed, including for different tiers of channels and cities, was arbitrary and irrational.
