AP enactment simplifies industrial procedures

HYDERABAD, July 26

THE Andhra Pradesh Government has enacted a legislation that makes single-window registration compulsory for all industrial clearances ensuring there are no hurdles for them while seeking permissions.

Entrepreneurs seeking various clearances from multiple agencies do not have to run from one department to another anymore.

The legislation envisages creation of district-level committees of officers to receive applications from entrepreneurs, forward them to competent authorities and communicate the clearances to them.

As per the enactment, a timeframe would be fixed for issue of mandatory clearances and non-adherence to deadlines by the competent authority would result in automatic deemed approval, according to the State Major Industries Minister, Mr K.Vidhyadher Rao.

While framing this new legislation, efforts have been taken to ensure adequate safeguards in framing the enabling rules.

Interestingly, the enactment also seeks to make officials responsible for delays in approvals beyond the deadline set by the Government under the enactment.

The enactment replaces the ordinance promulgated last month. This was initiated as only 10 per cent of the clearances were being passed through the Central Document Clearance Centre, under a single-window.

This enactment will facilitate the Government to systematically monitor the project development and also initiate corrective measures as and when required.

The Bill is aimed at providing speedy processing of various licences, clearances and certificates required for establishing industrial undertakings.

This is aimed at providing an investor-friendly environment in the State and matters relating to industrial permissions and clearances.

The State Government had announced a policy framework under the Industrial Policy 2002-2005, in which was spelt out that the single window registration for clearances will be made compulsory by law.

In pursuance of the policy, it has been decided to undertake a specific legislation to make single-window registration compulsory.

Under the enactment, the district-level and State-level committees would be competent to communicate the deemed approval to the applicants in the prescribed manner. The processing and decision-making powers continue to be vested with the concerned departmental functionaries. The measure covers clearances both for establishment and also for operation required before commercial production.

It may be recalled that the Government had also created escort officers who would be associated with companies aiding them in various clearances. This is a step ahead wherein it is made mandatory to extend clearances swiftly.
