HC restrains recovery of dues from SWC debtors

KOLKATA, June 12

MR Justice Bhattacharjee of the Calcutta High Court today restrained the tax authority from recovering the dues of the debtors of Shaw Wallace & Co Ltd (SWC) till July 7, 2003. In the meantime, the Government will file Affidavit and SWC also shall file rejoinder.

SWC filed an application in the Calcutta High Court for withdrawal of embargo on recovery of the amount from the debtors of SWC or from their bank account. SWC, in the course of its business, was deducting tax at source but the amount collected therefrom was not being deposited with the authority. Hence, a proceeding was started.

SWC moved the Delhi High Court but later withdrew the petition. At one point of time, it was urged that the money can be recovered from Andhra Pradesh Beverage Corporation Ltd but such proposal was withdrawn.

On March 26, SWC started proceedings at the Calcutta High Court with an identical prayer and a scheme was also submitted.
