Simpler excise norms to include exporters of readymade garments

RESPONDING to suggestions by textile exporters, with regard to exemption from the Central Excise registration for holders of declarant code number, the Central Excise department has now pointed out that the simplified export procedure prescribed under Chapter 7 - Part 3 of the Central Excise Rules (of the CBEC Manual), initially applicable only to exempted textile units, has now been extended to the 100-per cent exporters of ready made garments (RMGs).

It has been further clarified that the simplified procedure was applicable to only RMGs, and not for other items such as rugs, carpets etc.

The simplified procedure exempts exporters from obtaining Central Excise registration subject to fulfillment of certain conditions.

According to export promotion bodies, there was a confusion whether a unit engaged in 100-per cent exports was exempted from taking such registration, if it is already holding a declarant code, and whether the declarant code practice will continue in place of registration.

A further clarification was also sought whether an exporter having declarant code was allowed to send/receive goods from job workers without payment of duty, as per a recent departmental notification. It has now been clarified that with regard to procurement of duty-free goods to be used in the manufacture of finished export goods, the prescribed procedure, under the said Government notification read with the Central Excise (removal of goods at concessional rate of duty for manufacture of excisable goods) Rules 2001, is required to be followed.

A Central Excise registration is required and declarant code alone was not enough for availing exemption from the procedure.

Under the procedure, every textile exporter will have to periodically report on his export performance.
