Competition Commission

This is with reference to "A head for Competition Commission" (Business Line, November 20).

It is unfortunate that the judiciary has fiercely slammed the Government for appointing a bureaucrat as chairman of the Competition Commission.

As rightly pointed out in the article, the chairman of the Competition Commission is required to have more knowledge and expertise in company affairs than in legal provisions.

It is meant to restrain the big companies from abusing their "dominance" or resorting to any "anti-competition" practices.

Importantly, Section 8 of the Competition Commission of India Act 2002 provides for appointment of "somebody" who has "special knowledge" of, and professional experience in international trade, economics, trade administration and so on, as the chairperson of the Competition Commission.

It is, therefore, premature to question the appointment of a bureaucrat as the chairman without deciding the validity of the Competition Commission Act, which was passed by Parliament.
