THE Central Board of Excise and Customs (CBEC) has now come up with a new format for the monthly or quarterly return that has to be filed by a manufacturer who pays Cenvat duty or avails Cenvat credit.
The newly formulated return also specifies a separate column for the education cess, which has been levied on all Central taxes in the Finance Bill 2004.
An assessee is required to file a return, containing particulars of the quantity of goods produced and removed from a factory, the Cenvat duty paid and the Cenvat credit availed, within 10 days after the close of the month for which the return is being submitted.
The excise return is to be filed with the Superintendent of Central Excise.
However, in cases where an assessee is availing an exemption under a notification based on the value of clearances in a financial year, he would be allowed to file a quarterly return within 20 days after the close of the quarter for which the return is being submitted.
