MS India targets channel piracy

MICROSOFT Corporation India Pvt. Ltd has said that the Delhi High Court has issued restraining orders against four Delhi-based computer dealers selling pirated software.

"The four dealers namely Aanchal Computers Ltd, Shamrel Enterprises, MKS Compaq Systems and Supreme Peripherals Pvt Ltd were found selling personal computers installed with unlicensed copies of Microsoft Windows," a Microsoft release said here.

The computers sold by them were not accompanied by any licence agreement; certificate of authenticity; user manual or original CDs; which comes with the original licensed Microsoft software, it added.

In India, computer software is protected under Section 2 (O) of the Copyright Act, 1957, as a "literary work." Infringement of copyright is a civil offence, which provides for remedies such as injunction and damages the release said, adding it is also a criminal (cognizable and non-bailable) offence, punishable with an imprisonment term of up to three years and fine of up to Rs 2 lakh.
