Jayasimha Babu is new CESTAT President

THE Customs, Excise and Service Tax Appellate Tribunal (CESTAT) is to have a new President in Mr Justice R. Jayasimha Babu.

Mr Justice Babu, a former Judge of the Madras High Court, would come in the place of Ms Justice K.K. Usha, who retired in June this year, a revenue department official confirmed.

As CESTAT president, Mr Justice Jayasimha Babu would be the administrative head of the tribunal, exercising jurisdiction over the entire country. In addition, he has the same jurisdiction as that of a Bench over which he presides.

The Customs, Excise and Gold (Control) Appellate Tribunal was renamed as CESTAT from May 14, 2003, the date on which the Finance Bill 2003 received the assent of the President of India.

The appointment of Mr Justice Jayasimha Babu comes at a time when the Finance Ministry has been looking at major initiatives for recovery of tax arrears, both on the direct tax as well as indirect tax front.

The indirect tax arrears are estimated at about Rs 15,000 crore (including the undisputed tax arrears of Rs 3,000 crore).
