BSNL challenges TDSAT order on extending tariff cut to pvt operators

BHARAT Sanchar Nigam Ltd (BSNL) on Friday appealed before the Supreme Court challenging an order of the Telecom Dispute Settlement Appellate Tribunal (TDSAT), which directed it to extend its reduced tariff package to other basic and cellular operators.

BSNL had dropped long distance tariffs for its own mobile and fixed line customers while refusing to extend the benefits to customers of private operators on grounds that it was a commercial decision. BSNL's decision was challenged by the private operators.

Based on BSNL's plea, a Bench comprising Mr Justice D.M. Dharmadhikari and Mr Justice B.N. Srikrishna issued notices to the Association of Unified Telecom Service Providers of India and the Cellular Operator's Association of India.

BSNL pleaded before the Bench that the extension of the reduced tariff scheme to its competitors would mean that the private operators would benefit at its cost.

``One of the main issues involved in the present appeal is whether BSNL is obliged to extend benefits/reduction of tariff, which it offered to its own customers, to other competing operators for the purpose of calculating the interconnection charges payable by the said operators to BSNL on account of carriage of their calls on its network,'' the Solicitor-General, Mr G.E. Vahanvati, said while appearing on behalf of BSNL.
