Meeting on service tax on goods transport agency ends in impasse

THE first meeting of the Government appointed committee for service tax on goods transport agency services ended today in an impasse, with traders continuing to oppose the move to shift liability of payment of service tax on them even though they were not the service providers.

The matter has now been deferred till the next meeting, which will be held on March 11.

The committee was formed on February 10 to recommend the modalities for collection or payment of service tax in situations where registered partnership firms are involved, as either the consignor or consignee of the goods, and are liable to pay freight for transportation of goods by road in a goods carriage.

The committee was asked to suggest other measures for smooth implementation of service tax on goods transport agency services.

"As the matter is still under consideration and no amicable solution has been reached, the committee has unanimously recommended that the due date of registration with the department be extended from the earlier extended date of February 28, 2005 to March 31, 2005," Mr Praveen Khandelwal, Secretary General of Confederation of All India Traders and member of the committee, said here on Wednesday.

At the committee meeting, trade leaders submitted a written representation on the issue. They were of the view that only service providers should be made liable for service tax with respect to all services.

The traders said transporters were collecting and paying octroi and other charges in addition to freight charges, by charging in consignment note and depositing the same in the respective department. The traders said, similarly, the transporters should collect service tax from traders.

The traders asked why the matter was not mentioned to trade when the earlier committee submitted its report on October 27, 2004 and the notification was issued on December 3, 2004.
