Priyamvada will: Birlas to appeal against discharge of caveats

THE Birlas prayed for leave to move an appeal on Wednesday in the Division Bench of the Calcutta High Court comprising Mr Justice Pinaki Chandra Ghose and Mr Justice P.N. Sinha in the matter pertaining to the discharge of the caveats of the three Birlas.

In the appeal, the Birlas urged that the trial Court on March 11, 2005 discharged the caveats of the Birlas, excepting that of Mr G.P. Birla, , with regard to the will left by Priyamvada Birla and that the Court's order is wholly wrong.

The Court granted stay of four weeks at first instance, staying the operation of the order dated March 11, 2005 and extended it by a further period of four weeks ending on Wednesday.

The Counsel of R. S. Lodha raised an objection for moving the application on mentioning.

The Court, however, granted leave to move the application on May 12, 2005. Meanwhile, Mr Justice Kalyan Jyoti Sengupta of the Calcutta High Court on Wednesday ordered that the court-appointed Special Officers should make duplicate keys for opening of the almirahs and chests where Priyamvada Birla's articles are stored for making an inventory of the same at Kolkata, Delhi, Mumbai and Allahabad. The court further directed that if making of duplicate keys was not possible, they may break open the closed cupboards for carrying out an effective inventory.

On March 11, 2005, the Court, on an application for appointment of an administrator over the M.P. Birla Estate made by M. P. Birla's two sisters, Ms Radha Mohta and Ms Laxmibai Newar, appointed four Special Officers.
