Mumbai , June 28 THE Gujarat High Court has upheld the decision of Dr V. Kurien, Chairman of the Institute of Rural Management, Anand (IRMA), to remove Prof K. Pratap Reddy as its Director. The Division Bench that passed the judgment on Tuesday has quashed an earlier order by a single judge reinstating Prof Reddy as the Director of IRMA. While Prof Reddy was terminated from services as Director of the IRMA, citing charges, including breach of trust, this was challenged by him by way of a writ petition before the single judge of the High Court. Thereafter, interim relief was granted on the grounds that the petition was maintainable as it pertained to discharging public duty. IRMA went in appeal before the Division Bench of the Gujarat High Court challenging the order contending that IRMA is not a `State' within the meaning of Article 12 of the Constitution and that it does not discharge any public duty. The order of the single judge was also challenged on the grounds that the contract of service between IRMA and Prof Reddy, which is of a non-statutory character, cannot be enforced by way of a writ petition under Article 226. It was also argued that interim relief, which has the effect of allowing Prof Reddy to hold the post of Director, cannot be granted.
