Co-operatives IRMA case: HC sets aside Director's reinstatement Our Bureau
Ahmedabad , Sept. 20 IN a new twist to the ongoing power tussle at the Institute of Rural Management, Anand (IRMA), the division bench of the Gujarat High Court has set aside the reinstatement of Prof K. Prathap Reddy as Director of the institute. A single judge of the same court had, on August 30, passed an order reinstating Prof Reddy, who had been sacked as Director by his mentor turned rival, Dr Varghese Kurien. The order on Tuesday comes in response to a review petition filed by, Dr Kurien, against the single judge bench order. Dr Kurien's lawyers had contended that IRMA is not a "state" within the meaning of Article 12 of the Indian Constitution. The order was also challenged on the grounds that the contract of service between Prof Reddy and IRMA was non-statutory and could not be enforced by way of a writ petition, an IRMA press release said. It was also contended that the decision of Dr Kurien to terminate Prof Reddy was ratified by the institute board in its meeting on April 15. The division bench, while setting aside the order, has remanded the matter back to the single judge and directed the Assistant Charity Commissioner at Anand to decide on the change report filed by the two parties. Following the order, Prof Reddy has again gone in appeal.
