Roadways `States cannot allow transporters to carry excess goods with fine' Our Bureau
Kolkata , Nov. 11 THE Supreme Court has ordered State governments not to allow trucks and other goods transport vehicles to carry excess weight on roads and highways by imposing penalty on them and thus legitimising the overloading. A Bench, comprising Mr Justice A. Parasayat and Mr Justice C.K. Thakker, directed the States that had issued notifications under the Section 200 of the Motor Vehicles Act condoning the offence of overloading, to withdraw such notifications forthwith. According to Mr Chittaranjan Dass, Vice-President, All-India Confederation of Goods Vehicle Owners' Association (ACOGOA), several States such as Punjab, Haryana, Karnataka, Orissa, Rajasthan, Maharashtra and Uttar Pradesh had been allowing vehicles to carry weights in excess of the permitted limits by taking protection under the provisions of the Section 200 of the MV Act. The States thus legitimised carrying of excess load by compounding the offence and imposing the penalty. The Supreme Court order, Mr Dass hoped, would end such practices by the States and thus curb the menace of overloading by individual vehicle operators.
