Show-cause: Cellular players want new TRAI board to decide

The Cellular Operator's Association of India (COAI) has blamed the Telecom Regulatory Authority of India (TRAI) of having a predetermined mind in taking action against the companies which had failed to adhere to the quality of service norms.

Replying to the TRAI missive, which had rejected COAI's initial representation on the issue, the association said it was `shocked' and `distressed' at the way the issue was being handled and requested the authority to put on hold any further action till the new TRAI board took over.

"Your assertion that response to show-cause notice does not need any detailed information analysis shows that you have already pre-determined the issue and are considering the matter with a closed mind. If the purpose of show-cause notice is to let these companies give a proper response and reason for you not taking any action against them and it is a genuine exercise, then they must be given a proper opportunity of defending themselves and you cannot pre-judge the issue by stating what is relevant and what is not. Further, the issue in hand is not so emergent that the companies cannot be given an extension of time for giving a proper reply.

"In fact, from a press release, we find that you have claimed to take a final decision on the show-cause notices on March 20. Therefore, all these facts smack of a pre-determined mind doing the exercise in formality, and not in the spirit of true compliance with principles of natural justice," COAI said in its reply to TRAI.
