Lodha case: Counsel seeks search, seizure of documents

In the case against Mr R.S. Lodha, counsel for Mr R.P. Pansari resumed his argument on Monday before the Chief Judicial Magistrate, Alipur, seeking a search and seizure order of certain documents, connected with the alleged Will of Priyamvada Birla made in 1999. The documents are lying allegedly in the Birla Corporation office and residential houses of R.S. Lodha, S.K. Daga and three offices of Lodha & Co, Calcutta, New Delhi and Mumbai.
The counsel alleged that the said Will, made in 1999, is a forged one and papers and documents relating to revocation of five Charitable Trusts allegedly are in the houses of accused, which are essential for proving that a conspiracy was practiced by the accused persons for grabbing the entire assets of M.P. Birla Group for personal benefits.
Mr Asok Kumar Pal, Chief Judicial Magistrate, Alipur, adjourned the matter till September 2, 2006.
One of the accused persons, Mr V. Gouri Sankar, Senior Advocate of Supreme Court, died and the complainant filed an application that no order is asked for against the dead accused person.
