R.S.Lodha, EIIC appeal against CLB order

Both Mr R.S. Lodha and East India Investment Company Pvt. Ltd (EIIC) filed appeals in the Calcutta High Court on Wednesday, challenging the order of the Company Law Board (CLB), Eastern Region, Kolkata, which directed Registrar of Companies (ROC) to omit the name of Lodha and restore that of Priyamvada Devi Birla in respect of the 33,715 shares of East India Investment Co Pvt Ltd.
Mr Justice T.K. Dutta released the matter as the judge is hearing the appeals of both Birla and Mr Lodha in a Division Bench.
In the appeal, East India and Mr Lodha prayed for stay of operation of the order dated June 28, 2006, passed by the CLB, Kolkata directing ROC to omit Mr Lodha's name and restore Priyamvada Birla's name with immediate effect. In the appeals, it was stated that Mr R.S. Lodha entered his name in the shares of the company as an executor of the will of Priyamvada Birla, dated April 18, 1999. The contention of the said appeals is that there is no illegality involved in transferring shares of Priyamvada Birla to Mr Lodha's name.
The Chief Justice is now expected to assign the appeals to any other court.
