Courts/Legal Issues HC directs employers to implement PF, ESI laws strictly Our Legal Correspondent
Chennai June 23 The Madras High Court has directed the Employees Provident Fund authorities, Employees State Insurance Corporation and employers to implement strictly the principles of EPF & Miscellaneous Provisions Act and ESI Act, and warned that any violation of same would be viewed seriously. Allowing writ petitions from United Labour Federation, Chennai praying for issue of directions to 1st (Regional PF Commissioner) and 2nd respondent (ESIC) to take appropriate action against 3rd respondent (management of Sri Saraswathi Mills Ltd, Tiruttani Taluk) to ensure that arrears of contributions due from third respondent from the year 1998 onwards, including contributions deducted from wages of workers, were duly remitted forthwith, Mr Justice K. Chandru cited the judgment of Full Bench of this Court [reported in 2006 (5) CTC 1] saying that PF dues were not covered by Section 22(1) of Sick Industrial Companies (Special Provisions) Act, 1985. Adverting to submission of counsel for petitioner that workers and their families were deprived of benefits that they were entitled to under the two laws, the judge said that if any such incidents were brought to notice of this Court, the Court would not be hesitant to take action against the authorities of PF and ESI.
