Sundaram Ind told to pay difference in wages

Chennai, Sept 18

The Madurai Bench of the Madras High Court has directed Sundaram Industries Ltd (Rubber Factory), Madurai, to pay to workmen their claim of difference in wages as compared to other workmen covered by settlement under Section 18(1) of the Industrial Disputes Act dated December 3, 1998.

The court, while allowing a writ petition by the Sundaram Industries Employees Union challenging order dated April 12, 2004 of the Labour Court, Madurai, rejecting claim petition of the Union, held that 2nd respondent Labour Court was indulging in technical objection and denying right of workmen stating that benefit of the said settlement was available only to parties to settlement. According to the petitioner, management refused to make payment of difference in wages as compared to the workmen covered by settlement dated December 3, 1988. The management contended that a settlement under Section 18(1) of the ID Act was only binding on parties to dispute and members of petitioner union. Insofar as they were not party to proceedings, they were not eligible for revised wages in terms of settlement. The management was directed to make payment within 4 weeks.
