IPR Wipro gets injunction against ‘Oushadha Chandrika’
Wipro is the exclusive owner of ‘Chandrika’ and has acquired all rights along with goodwill. Our Bureau Bangalore, Oct. 13 Software-to-soaps maker Wipro Ltd has obtained an interim injunction against the Kerala-based Oushadha Chandrika Ayurvedics for manufacturing toilet soaps under the trademark ‘Oushadha Chandrika’. Wipro bought over the trademark ‘Chandrika’ from Chandrika family in 2004 through its subsidiary Wipro Chandrika Ltd. Wipro Chandrika is the exclusive owner of the trademark and has acquired all rights in the trademark along with goodwill, a press statement from Wipro said. During July, it was found by Wipro’s sales team that a party trading under the “name & style,” of Oushadha Chandrika Ayurvedics India (P) Ltd, Kerala, had started manufacture of toilet soap under the trademark ‘Oushadha Chandrika’. The company filed a suit for infringement before the Chennai High Court and obtained order of interim injunction against the party. The High Court has prohibited Oushadha Chandrika Ayurvedics from manufacturing and selling soaps under the trademark ‘Chandrika’, ‘Oushadha Chandrika’ or any deceptively similar mark or using any cartons of the colour scheme, “get up” similar to Chandrika, until further orders from the Court. It also appointed an Advocate Commissioner to visit the premises of Oushadha Chandrika Ayurvedics and to take inventory of all soaps and packaging material bearing the trademark ‘Oushadha Chandrika’. Armed with the order of the Chennai High Court, the Advocate Commissioner visited the premises on October 10, and served copies of interim injunction order. The Advocate Commissioner also took inventory of all the finished goods and packaging, wrappers and would submit its report as directed by the Court. Similar notice was served on a wholesaler in Thrissur who was stocking and selling goods manufactured by the party under the trademark Oushadha Chandrika. Mr Anil Chugh, Senior Vice-President, Sales and Marketing, said that Wipro values its trademarks highly and any threat to the company’s IPRs would be dealt with strongly.
