Courts/Legal Issues Bata India gets HC stay on PF dues Our Legal Correspondent Kolkata, March 10 Bata India Ltd (BIL) obtained an order of stay from the Calcutta High Court on Monday with regard to the order passed by the Provident Fund Authority, directing the company to deposit Rs 5.68 crore in connection with PF dues. Bata India Ltd moved a writ petition challenging the order of the Provident Fund Commission dated December 12, 2007, and March 3, 2008, issued under the Employees Provident Fund Act. While admitting the writ petition, Mr Justice D. Kar Gupta stipulated conditions upon BIL, asking them to furnish bank guarantee to the tune of Rs 2 crore to the Board of Trustees and the PF authority. The court also directed BIL to furnish an undertaking to the Board of Trustees to the effect that in the event of the writ petition failing, the entire amount to be given to the Board of Trustees and PF by BIL. The court directed the parties to file affidavits. The matter will appear for final hearing after five weeks. BIL, in its petition, prayed for an injunction restraining the PF authority from taking any step prejudicial to Bata and not to give effect to the order dated December 12, 2007, and March 3, 2008, by PF authority, which was obtained on the ground of maintainability of the petition.
