HC dismisses plea against current season sugarcane SAP

Chennai, July 7 The Allahabad High Court on Monday dismissed a writ petition challenging the State Advisory Price (SAP) fixed by the Uttar Pradesh Government for the sugarcane supplied by the farmers to the mills.

A division bench comprising Mr Justice Pradeep Kant and Mr Justice S.N. Shukla dismissed the petitions filed by the Western U.P. Sugar Mills Association along with other associations and sugar mills in the State, saying the State Government had powers to fix SAP as per the Supreme Court’s ruling. The judges asked the mills to pay farmers the SAP fixed by the State Government and the arrears in case the full payment had not been made. They also gave two months time for payment of the dues to the farmers.

The Association had challenged the SAP, fixed over and above the Statutory Minimum Price fixed by the Centre, stating that there were no guidelines fixed for arriving at such prices and they had not been given a fair hearing.

The Uttar Pradesh Government had fixed Rs 125 a quintal as SAP for common variety sugarcane and Rs 130 for early variety canes for the 2007-08 season ending October.

Slew of writs

A slew of writ petitions challenging the 2006-07 SAP fixed by the Uttar Pradesh Government is being heard by the Lucknow bench of the High Court as well as the Supreme Court. In May this year, the apex court had ordered payment of Rs 110 a quintal for sugarcane supplied by growers to the mills pending a final verdict by the High Court.
