Roadways Industry & Economy - Courts/Legal Issues States - West Bengal Kolkata ban on 15-year old public vehicles Our Legal Correspondent Kolkata, July 18 All public vehicles 15 years old have been prohibited to ply in Calcutta Metropolitan regions from March 31, 2009. On a public interest litigation (PIL), filed by a social welfare organisation, the Division Bench comprising the Chief Justice, Mr S.S. Nijjar, and Mr Justice Pinaki Chandra Ghose passed the order on Friday. Pollution levelsIn the petition it has been stated that the scale of pollution spread over the city, such restriction is necessary. The quantum of carbon monoxide emit excessively from the old vehicles, so the restriction of 15 years is needed to control air and dust pollution. About auto rickshaws, the court has imposed restriction, that from the same period, all auto rickshaws, plying in metropolitan areas shall use LPG. OrderThe State Department of Environment, has issued an order no. S/EN/1517/611/08 dated July 17, 2008 to this effect in exercise of power U/S 20 of the Air (Prevention & Control of Pollution) Act, 1981 and the restrictions followed, on that basis to the PIL, filed in the court.
