The Debt Recovery Tribunal (DRT) Bengaluru on Friday dismissed interlocutory application filed by Kingfisher Airlines seeking permission to make amendment to its original objection filed against the SBI-led consortium of banks’ plea .

DRT Presiding Officer CR Benakanahalli issuing orders on interlocutory application read out the order by saying “Defendant’s Application stands dismissed.”

On Wednesday, KG Raghavan, senior counsel appearing for Kingfisher Airlines, had appealed before the DRT Presiding Officer stating that his client (Kingfisher Airlines) be allowed to file an interlocutory application seeking amendment to original application.

Kingfisher Airlines’ amendment was mainly a counterclaim for losses incurred when banks failed to honour their commitments as per the Master Debts Recast Agreement dated October 21, 2010.

Kingfisher Airlines counsel pleaded that amendment application be accepted and sought ₹3,300 crore from banks which it claims was not disbursed on-time for various proposed projects of the company as per the MDRA. “By non-release of money resulted in the company incurring losses,” Kingfisher counsel contended.

“Banks stifled every attempt of the company by their single point agenda of recovery which also resulted in company incurring loss.

“There should have been handholding by the banks. That did not happen instead breach of agreement took place.”

Urging the DRT Presiding Officer not to entertain the Kingfisher Airlines’ application, SS Naganand, counsel representing the SBI-led consortium contended that it is bard by time.

The application not be allowed ‘according to its whims and fancies’ and that the limitation period of the right to claim amendment had elapsed.
