Income Tax Industry & Economy - Consumerism Columns - Listening Post An empty threat
I am a college lecturer. I have filed my returns along with Form 6 issued by my employer. Recently, I received a letter from income-tax office stating that tax was due and if I failed to make payment, the department would attach my salary. I checked with my auditor to know whether an assessment order was passed that could have resulted in a tax demand due from me. I was informed that no order of intimation under Section 143(1) or rectification under Section 154 was served to him. I have not received any such letter or order whatsoever from the Department. My auditor informed me that without an order of assessment or notice of demand, no tax recovery can be made and the Assessing Officer has to explain how the tax is due. In the absence of any information, a letter seeking details has to be addressed to the Assessing Officer and only on receipt of such letter further steps can be taken. To a salaried employee a letter threatening attachment of salary without a valid order of assessment is really discouraging and disgusting. Based on tales of real-life tax hassles.
