The Bureau of Indian Standards has pulled up Toshiba Transmission & Distribution Systems (India) Pvt Ltd for misuse of its licence norms.

It has directed Toshiba to apply for its certification marks licence, while imposing a penalty of three months.

The BIS, part of the Union Ministry of Consumer Affairs, Food and Public Distribution, has through the Deputy Director- General South, issued a notice for violation of norms leading to personal hearing of the representatives of the company with regard to use of standard mark on outdoor type oil immersed distribution transformers.

In a communication to the company, which has come through an acquisition of assets of Vijay Electricals including manufacturing unit in Medak, BIS stated, “after careful examination of the facts of the case and statements made, documents submitted by the company,” observed, “You have violated the conditions of grant of licence by using BIS Standard Mark on a variety not covered under the scope of your licence”. Hence, the competent authority of the Bureau has decided to cancel the licence with effect from May 5, as per the provisions of the BIS Act 1986, read with relevant rules.

It further stated that the company was not entitled to use the standard mark on the Outdoor Type Oil Immersed Distribution Transformers-Part 1, Mineral Oil immersed or to claim in the advertisement or any publicity material that the company is a licensee to use the mark on this type of transformer after May 8, 2017.

The company was directed that any publicity material such as hand bills, pamphlets and so on, claiming that it holds BIS certification for this product should be destroyed or such marking obliterated/defaced immediately.

Toshiba has been directed to surrender the original licence along with all attachments and endorsements and submit an undertaking that it has not retained a copy of the licence.

It has been permitted to apply afresh only after August 5, 2017, with the Competent Authority imposing a penalty period of three months.
