Hooking a customer with assurances and promises to install a UNIX unified operating system (UOS) to enable the use of peripherals purchased without having any intention to do so was a gimmick. It was like dangling a carrot on a stick.

It could not, therefore, be said that the sale of goods was complete after delivery of peripherals.

It is like offering a car for sale without a steering wheel and transmission machine or brakes.

Museum piece

Absence of any essential part would render the merchandise as useless as a museum item or junk.

The same would be the case when the Unix unified OS was not installed because, in that event, the other peripherals were useless.

As long as they were dysfunctional, they were goods worth nothing. These peripherals work in unison with the OS and not in a standalone mode.

These were the telling paraphrased words of the Madhya Pradesh High Court in Sanghi Brothers v. Methodex System Ltd while upholding the trial judge’s verdict that the respondent did not deserve to be paid for supplying an incomplete machine.
