The Tamil Nadu Electricity Regulatory Commission (TNERC) has castigated the State electricity utilities in a case relating to non-implementation of the Commission's earlier orders, saying that utility's “intentions are not honourable”.
On September 7, 2010, the Commission had passed an order directing the Tamil Nadu Electricity Board to pay certain dues to a power generator in the State, Sai Regency Power Corporation Pvt Ltd. TNEB (now Tangedco, the generation and distribution subsidiary of TNEB) has not honoured the order.
Consequently, Sai Regency Power filed a contempt petition on March 31, this year. Tangedco responded to it by filing a ‘clarificatory petition' on June 13.
This was done “with the obvious intention of thwarting the contempt proceedings”, says an order of TNERC passed on Friday.
“This is plain and simple abuse of the process of law,” the Commission said, noting that if Tangedco wanted a clarification, “the petition could have been filed within a month.” Coming down heavily on Tangedco for “intentions not honourable”, the Commission also noted that “Tangedco takes things very lightly and casually.”
Other cases too
The Commission's displeasure over TNEB and its subsidiary, Tangedco, comes out similarly in a very clear fashion in the other orders it passed on Friday too.
For instance, in a case filed by Cauvery Hi-tech Weaving Park against TNEB, the Board did not file a counter even though the due date for that expired in May. Allowing one more week for filing the counter, the Commission noted, “The TNEB seems to be taking the Commission for granted.”
In another case filed by Tangedco against Durgesh Nandini Spinning Mills Ltd, the Commission directed the Chairman and Managing Director of Tangedco to “take appropriate action against the Chief Financial Controller of Tangedco, who was absent at the hearing.
In yet another case the Commission took “strong exception” to the absence of the Chief engineer, NCES, and directed the Chairman and Managing Director of Tangedco to take “appropriate action” against the officer “for the inconvenience caused to the Commission” and also report action taken within fifteen days.
