It is the poor and the illiterate who need the focused attention and diligent efforts of lawyers representing them, others are articulate enough to guide the lawyer's course of action, held the Delhi High Court.
A benighted villager, Braham Prakash, was forced to sell his share of the joint property, and this was upheld by the lower court. The Delhi High Court on examining the facts of the case felt otherwise, and went on to hold the lawyer representing him responsible for losing an eminently winnable case.
Justice was on the petitioner Braham Prakash's side but the lawyer representing him in the lower court did a shoddy work and lost the case due to his callousness.
The Delhi High Court absolved the petitioner of his obligation to sell his share of the joint property and asked him to return the advance received.
