Hyderabad has the highest number of prosecution cases against chronic provident fund (PF) default by companies.

Up to March 31, 2010, a total of 2,219 cases had been filed against defaulting firms in Hyderabad, followed by 1,746 in Kolkata, 1,546 in Patna, 1,419 in Ahmedabad and 1,378 in Indore. These include cases concerning delay in submitting PF returns.

This information was given to the Lok Sabha on Monday by Union Labour Minister, Mr Mallikarjun Kharge.

Mr Kharge said PF returns were pending from 12,0165 companies across the country. Of these, the highest number of defaulting firms was in Hyderabad at 20,213, followed by 18,666 in Maharashtra, 13,734 in Tamil Nadu and 11,842 in Delhi.

The Labour Minister said during 2010-11, a total of 1,56,578 complaints were received, of which 1,38,745 were disposed of.

As per Section 14(2) of the Employees' Provident Funds & Miscellaneous Provisions Act, 1952, default in submission of return is a punishable offence and liable for prosecution. It is mandatory for establishments covered under the Act to submit the PF returns as per the time stipulated. Any delay in submission of PF returns or non-submission leads to workers becoming victims, Mr Kharge said.
