Developers of solar power projects who wanted an extension of time beyond January 29 to avoid coming under a lower tariff regime (than they would have if they had completed their projects by January 29) have lost their case. The Gujarat Electricity Regulatory Commission has decided against them.

“We decide that the petitioners have not succeeded in making out a case for invoking the inherent power of the Commission to extend the control period determined by the Commission in its Order No. 2 of 2010 dated 29 January 2010,” the Commission said in its order dated January 27.

The developers wanted more time to complete their projects. They cited issues relating to land acquisition, evacuation infrastructure, flooding of the project site and insufficient time to do the project as grounds for their prayer.

But the Commission, observing that project worth 587 MW out of the total PPA-signed projects worth 968 MW had met the January 29 deadline, refused to grant time extension. Those who do not meet the deadline will have to contend with a lower tariff than that envisaged in the PPA — Rs 15 a unit for the first 12 years and Rs 5 a unit for the next 13 years.
