The government is all set to re-promulgate the Land Ordinance even as the Bill has been referred to a Joint Parliamentary Panel.

“A note for the Cabinet is being prepared and taken up, after the President pro-rogues both houses of Parliament,” a senior Government official told BusinessLine . The Cabinet is expected to consider it during the week starting May 25, as by then the Government expects to have prorogued order from the President.

The ordinance has already been promulgated twice, first on December 31, 2014 and second on April 3, 2015. The current ordinance will lapse on June 3 and next session of Parliament is expected to begin only around July 20.

On the need for re-promulgation, the official said that it is to ensure higher R&R (Rehabilitation and Resettlement) package for the farmers whose land have been acquired under 13 laws (such as the National Highways Act, 1956 and the Railways Act, 1989) on or after January 1, 2015.

The entire exercise of re-promulgation is being initiated at a time, when the government has failed to evolve a consensus on ‘Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Amendment) Second Bill, 2015.’

The government had no problem in getting the Bill passed in the Lok Sabha because its majority, but in the Rajya Sabha it is in minority.

Asked if it is possible to re-promulgate the ordinance under this situation, the official said the previous government had re-promulgated the SEBI ordinance even the Bill was referred to the Standing Committee.

On Thursday, Parliamentary Affairs Minister M Venkaiah Naidu said, “There are processes and there is precedence (for re-promulgation).”
