Mr Sanjay Chandra, the Managing Director of Unitech Wireless Pvt Ltd and an accused in the 2G case, told the Supreme Court on Monday that he is entitled to bail as the CBI has only “fabricated evidence” against him.

Senior advocate Mr Ram Jethmalani, representing Mr Chandra, told the apex court that his client has not done anything illegal adding that, “They (CBI) were so desperate that they fabricated evidence (against Mr Chandra).”

Mr Jethmalani said the agency was trying to mislead the court by claiming that the promoters of the company had made huge profits by selling stakes immediately after getting the licences.

He said the company had invited foreign investment and issued additional shares as the Government policy had permitted 74 per cent foreign equity in the telecom sector.

“But we have not sold a single share of our own,” he added.

Besides, Mr Jethmalani said the CBI has not given any document on the basis of which they have alleged the charge of forgery against his client, adding that the agency also does not have anything to show against Mr Chandra on the charge of cheating.

He also said the CBI's case of putting all the accused companies under a single conspiracy was not legally plausible especially since they were rival companies.

Mr Jethmalani will continue his arguments when the matter is heard again on September 5.

The court was hearing the appeals filed by Mr Chandra and another accused Mr Vinod Goenka, the Director of Swan Telecom and Managing Director of DB Realty, against the order of the Delhi High Court, which had dismissed their bail plea.

Both are lodged in Tihar jail.
