The CBI was on Wednesday allowed by a Delhi court to interrogate Asif Balwa and Rajeev Agarwal, arrested for their alleged role in the 2G spectrum allocation scam for transferring Rs 200 crore to Kalaignar TV Pvt Ltd, in its custody for two days.
Special CBI Judge O P Saini allowed CBI’s plea saying that as per the allegations against both the accused, they were “instrumental in transferring Rs 200 crores in accounts of Kalaignar TV Pvt Ltd”.
Tamil Nadu Chief Minister Mr M Karunanidhi’s daughter and DMK MP Ms Kanimozhi, her mother Ms Dayaluammal and Mr Sharad Kumar, Managing Director of Kalaignar TV Pvt Ltd, have 20, 60 and 20 per cent equity in the company.
It is alleged that Rs 206 crore investment has been made by subsidiary of Shahid Usman Balwa’s company DB Realty in Kalaignar TV during 2008-10. He has already been arrested by the CBI in connection with the case.
Others arrested in the case also include former telecom minister A Raja, his private secretary R K Chandolia and former telecom secretary Siddharth Behura.
Agarwal has 50 per cent equity along with Balwa’s cousin Asif Balwa in company’s subsidiary - Kusegaon Fruits & Vegetables Pvt Ltd - from where the money had moved to Cineyug Films Pvt Ltd and subsequently to Kalaignar TV.
“Considering the nature of the case, the allegations against the accused persons that they were instrumental in transferring a sum of Rs 200 crore in the accounts of M/s Kalaignar TV Pvt Ltd, through the accounts of Cineyug Films Pvt Ltd, non-production of agreement dated December 19, 2008 ....I find that prayer for police custody remand is fully justified.
“Accordingly, both the accused are remanded to police custody remanded to police custody remand April 1,” the court said.
Rajeev Agarwal and Asif Balwa, arrested by the CBI yesterday, were directors of Kusegaon Fruits and Vegetables Pvt Ltd. Agarwal is also Director of Conwood Constructions and Developers Pvt Ltd (a partner of Dynamix Realty).
Asif, cousin of Swan Telecom Promoter Shahid Usman Balwa, who is presently in judicial custody in the 2G scam, is also the Director of DB Realty Pvt Ltd, a partner of Dynamix Realty.
