Two former Disney employees have filed separate lawsuits in a US court against Disney and IT consulting companies HCL and Cognizant, claiming that the companies brought in Indian workers on H-1B visas to replace Americans.

The complainants Leo Perrero and Dena Moore, who were both fired from Disney last year, claim the three companies colluded to break the law by using temporary H-1B visas to bring in immigrant workers, knowing that Americans would be displaced.

Leo Perrero said in his lawsuit that in October 2014, he and about 200-300 other Disney employees, who are US workers and employed in the Disney IT department, were told to train hundreds of H-1B visa-holders.

Perrero further says that he along with the other employees were “told by Disney management that they were being fired on January 30, 2015”.

“Although Disney management told the Plaintiff and other 200-300 employees that there were job openings for them, very few (only a couple) employees were rehired after being fired on January 30, 2015,” the lawsuit states.

None of the companies responded to e-mails sent by BusinessLine seeking comments on the issue but executives in HCL and Cognizant said on conditions of anonymity that they followed visa rules. Disney, in a statement to New York Times, said the allegations were based on misrepresentation of facts.
