India will have access to bank details from Mauritius if the latter were to agree to an amendment to the relevant Article on information exchange in the existing double taxation avoidance agreement (DTAA) between the two countries. This was stated by the Minister of State for Finance, Mr S.S. Palanimanickam, in a written reply to a Rajya Sabha question on India-Mauritius DTAA.

A joint working group (JWG) comprising members from the Indian Government and Mauritius Government was constituted in 2006 to put in place adequate safeguards to prevent misuse of India Mauritius DTAA. Six rounds of discussions have taken place so far.

“There was unwillingness on the part of Mauritius to co-operate in addressing this problem (misuse of treaty). We have now proposed next round of discussions to which Mauritius is yet to respond,” Mr Palanimanickam said. The existing DTAA does not specifically provide for exchange of banking related information for tax administration purposes.
