Faridabad-based Kant Enclave’s home buyers plan to approach the Supreme Court this month with a review petition, seeking relief from the earlier apex court order on this matter.

The Supreme Court had on September 11 ruled that the constructions done under Punjab Land Preservation Act (PLPA) was illegal and that the colony be demolished. Residents of the colony see themselves as victims of the State government’s lapse and want the apex court to allow them to continue staying in the existing premises in Kant Enclave, which has now been treated as an illegal construction. They also want to move the State government authorities to hear their petition.

“We would request the SC to give us relaxations similar to the ones they have given to the home buyers in various cities in the past,” said Sanjay Basu, one of the residents. As per the recent judgement of the supreme court, all construction that have come up on PLPA notified land is illegal and should be demolished.

Dipank Kant, Partner, R Kant & Co, who owns majority stake in the Kant Enclave project, said that the total land in Haryana which is notified under section 3/4/5 of PLPA Act is about 1.85 lac acres or more. This covers Kant Enclave, Manav Rachna College, Taj Vivanta hotel among others.

Right now, there are approximately 30 homes in the colony.
