The Delhi High Court has asked DDA and private developer Emaar MGF to complete formalities and hand over possession to those who were allotted flats in the residential towers in the Commonwealth Games Village here.

The court, however, said 28 “unencumbered” flats of Emaar MGF in the CWG village would be kept as security to ensure payment of compounding charges, if any, on account of alleged excessive construction in flats by the private developer.

Justice G. S. Sistani also asked DDA to not grant completion certificates to 28 other flats belonging to it.

“For the balance flats a completion certificate will be granted and the petitioners (Commonwealth Games Village Allottees’ Welfare Association and other allottees) will be given possession on the completion of all formalities by the project developer,” the court said.

The decision came on two separate pleas filed by the CWG Village Allottees’ Welfare Association and others, including, Anoop Sharma, alleging that despite making all the payments, the purchasers have not been handed over possession of the flats as DDA has not issued “completion certificates”.

Disposing of the pleas, the court passed a slew of guidelines and asked DDA and Emmar MGF to complete formalities required for grant of flats’ possession to the purchasers.

“A request will be made by DDA to the Ministry of Urban Development to regularise excess construction at the Commonwealth Village Complex,” it said, adding that the Ministry would hear them and take a decision “keeping in mind the peculiar facts and the extent of hardship which may be caused to a large number of flat owners (1,168) especially in case demolition is to be carried out in each flat.”
