India’s largest air cooler maker Symphony Ltd on Thursday got a stay order from the High Court of Gujarat against Wim Plast Ltd which is launching ‘Cello’ brand air cooler models in India, said to be similar to the registered designs of Symphony’s models.
In a statement here, the Ahmedabad-based company, quoting the High Court order, said the court had, by way of ad-interim relief, restrained the respondents (Cello) from marketing, selling, advertising and directly or indirectly dealing in air coolers which have the same design, shape, configuration and design identical to and/or imitation of the petitioner’s (Symphony) product designs.
Symphony informed the High Court that Wim Plast’s ‘Mega Cool’ model is more or less identical to Symphony’s ‘Winter’ model, its ‘Maxi Cool’ model was similar to Symphony’s ‘Sumo’ model, while another ‘Ever Cool’ model was identical to Symphony’s ‘Diet’ model and ‘Ultra Cool’ model was a copy-cat of Symphony’s ‘Hi-Cool’ model.
