Flipkart settles ‘cautionary note’ dispute with Nikon

Japanese firm won’t name e-commerce portals in notice to customers 

Nikon India on Wednesday told the Karnataka High Court that it will put out a general cautionary note for customers to check warranty entitlements while buying its products from e-commerce portals without naming retailers such as Flipkart.

The counsel for Nikon made this submission during the hearing of an appeal filed by Flipkart, which had questioned a July 16 order of a City Civil and Sessions Court refusing to grant injunction restraining Nikon from naming Flipkart in the cautionary note.

Meanwhile, the counsel for Flipkart agreed to Nikon’s decision to put out the general cautionary note about the purchase of its products.

Justice BS Patil, before whom the appeal came up for hearing, disposed Flipkart’s plea as the issue is no more relevant. The Court has also asked Flipkart to withdraw or seek dismissal of the suit pending before the civil court.

The notice on Nikon’s India website had said: “Please note that e-commerce websites like Flipkart, Snapdeal are not our authorised partner/dealer. We advise you to check the warranty entitlements while buying from online portals.”

Defamation

In its suit, Flipkart had contended that Nikon India had defamed its name and sought an apology. However, Nikon claimed that it did not intend to target or defame a particular e-commerce portal in its cautionary note, which was general in nature.
