Court allows framing of charges against Tech Mahindra in a Satyam case

A Division Bench of Hyderabad High court comprising Chief Justice Kalyan Jyothisen Gupta and Justice P.V.Sanjay Kumar has permitted the Special Court to continue with process of framing charges against Tech Mahindra in criminal case initiated by Encorfcement Directorate.

The Bench on Wednesday directed the Tech Mahindra Ltd, (formerly Satyam Computer Services Ltd) to appear before the trial court and participate in framing of charges against it.

The Bench was passing these interim orders by suspending order of single judge who had declared that Enforcement Directorate could not have proceeded against Tech Mahindra in the Satyam Computer scam case. The Enforcement Directorate had registered a case against 213 accused including the main company.

Tech Mahindra had approached the High Court contending that they could not have been shown as accused as this company was not in existence when the alleged crime of money laundering had taken place.

The Enforcement Directorate filed the present appeal challenging the orders of the single judge. The Bench said that the process of framing the charges can go on.

If the Special court frames the charge against Tech Mahindra further action may not be taken. The appeal is adjourned for further hearing after April 20 when the special court is expected to frame charges.
