The CBI was today allowed by a Delhi court to interrogate Mr Asif Balwa and Mr Rajeev Agarwal, arrested for their alleged role in the 2G spectrum allocation scam for transferring Rs 200 crore to Kalaignar TV Pvt Ltd, in its custody for two days.
The Special CBI Judge, Mr O.P. Saini, allowed CBI's plea saying that according to the allegations against both the accused, they were “instrumental in transferring Rs 200 crore in accounts of Kalaignar TV Pvt Ltd”.
The Tamil Nadu Chief Minister, Mr M Karunanidhi's daughter and DMK MP, Ms Kanimozhi, her mother Ms Dayaluammal and Mr Sharad Kumar, Managing Director of Kalaignar TV Pvt Ltd, have 20, 60 and 20 per cent equity respectively in the company.
It is alleged that the Rs 206-crore investment has been made by subsidiary of Mr Shahid Usman Balwa's company DB Realty in Kalaignar TV during 2008-10. He has already been arrested by the CBI in connection with the case.
Others arrested in the case also include former Telecom Minister, Mr A. Raja, his private secretary, Mr R.K. Chandolia, and former Telecom Secretary, Mr Siddharth Behura.
Mr Agarwal has 50 per cent equity along with Mr Balwa's cousin Mr Asif Balwa in company's subsidiary – Kusegaon Fruits & Vegetables Pvt Ltd –— from where the money had moved to Cineyug Films Pvt Ltd and subsequently to Kalignar TV.
“Considering the nature of the case, the allegations against the accused persons that they were instrumental in transferring a sum of Rs 200 crore in the accounts of M/s Kalaignar TV Pvt Ltd, through the accounts of Cineyug Films Pvt Ltd, non-production of agreement dated December 19, 2008 ....I find that prayer for police custody remand is fully justified.
“Accordingly, both the accused are remanded to police custody remanded to police custody remand April 1,” the court said.
Mr Rajeev Agarwal and Mr Asif Balwa, arrested by the CBI on Tuesday, were directors of Kusegaon Fruits and Vegetables Pvt Ltd. Mr Agarwal is also Director of Conwood Constructions and Developers Pvt Ltd (a partner of Dynamix Realty).
Mr Asif Balwa is also the Director of DB Realty Pvt Ltd, a partner of Dynamix Realty.
