Mr Vinod Goenka, Director of Swan Telecom and Managing Director of DB Realty, on Wednesday denied all charges against him in the 2G scam.
Mr Goenka, an accused in the case, told the Special Court hearing the matter that he did not have anything to do with the telecom business of Swan Telecom. Instead, it was Mr Shahid Usman Balwa, an accused in the case and MD of Swan, who was looking after the business, including obtaining 2G licence, after being authorised by the board.
He claimed that the CBI had levelled “vague and unsound allegations” against him, adding that the investigating agency did not have any evidence against him to make him liable for conspiracy, cheating or other offences.
Mr Goenka said he cannot be held liable only because he is the director of the company. He added that the principle of vicarious liability cannot be applied in this case because then the CBI should have arrested all the directors of other companies too.
He said liability can only be based on the role a person in the case, adding that he has no role in the matter.
Citing the Telecom Minister, Mr Kapil Sibal's statements, he said the exchequer did not incur any loss due to the allocation of 2G spectrum in 2008.
