Nestle India on Thursday questioned the jurisdiction of the National Consumer Disputes Redressal Commission to hear the class action suit that has been filed by the government against the company.

It also opposed the need for fresh tests of Maggi Noodles samples. The NCDRC has now posted the matter for hearing on October 15.

A bench of Justice V K Jain and Justice B C Gupta was hearing the class action suit filed against the company by the government. Responding to an e-mail query on the developments on Thursday, Nestle India said that the matter is being argued and it was not in a position to comment.

The company has argued that earlier test reports conducted by the States had been rejected by the Bombay High Court and the court has ordered fresh tests in government accredited laboratories.

The tests are being carried out at NABL-accredited labs at Hyderabad, Mohali and Jaipur.

Opposing the government’s plea for fresh test of Maggi Noodles samples in accredited laboratories, the company said that it was waiting for these test results which are likely to come in a few days.

It added that parallel tests do not make much sense.

In August, the Ministry of Consumer Affairs had filed a class action suit against Nestle India in NCDRC seeking about ₹640 crore in damages.

Nestle India has raised concerns about the maintainability of the complaint with the NCDRC.
