The Delhi High Court on Tuesday directed the Department of Information Technology of the Union Government to submit the papers relating to sanction for prosecution of Google India and social networking site Facebook for allegedly hosting objectionable contents.
Mr Justice Suresh Kait passed the direction order when counsel for Google India submitted that the Union Government had no locus to interfere in the matter as it was a complaint case.
Countering the argument, counsel for the Delhi Police said that the investigating agency had submitted a report to the lower court when the latter had asked for one. Counsel for the city police further submitted that the Department of Information Technology had also given sanction for prosecution of the responsible sites, including Google India, saying that it was a fit case to initiate proceedings.
Thereupon, Mr Justice Kait asked the Department to submit papers relating to the sanction for prosecution on February 15.
The trial court had on December 23 summoned representatives of as many as 21 networking sites taking cognisance of the private criminal complaint.
